1. Purpose of the contract

These general terms and conditions (GTC) govern the services provided by Chris Medical Services Sàrl, a company specializing in medical devices for events.

2. Contract formation

The contract is formed upon validation of the offer issued by Chris Medical Services Sàrl. This validation implies unreserved acceptance of the GCS.

3. Provider’s services

  • Assess needs based on information provided by the customer.
  • Provide a device that complies with cantonal standards, IAS recommendations and health requirements.
  • Provide qualified personnel, medical equipment and, if necessary, medical vehicles, according to the validated plan.
  • Keep an activity log and draw up a health report to be sent to the authorities and the customer.

4. Customer’s obligations

  • Provide all relevant documents (plans, organization file, permits, etc.).
  • Provide an accessible, stable, flat first-aid station with electricity, water and toilet facilities.
  • Guarantee the safety of staff and sanitary equipment.
  • Maintain regular contact with the station manager during the event.

5. Offer and prices

  • The first offer and its correction are free of charge.
  • Prices are in Swiss francs (CHF) and are not subject to VAT.

6. Billing and payment

  • The invoice is issued on the basis of the validated offer.
  • Payment is due within 15 days of receipt.
  • In the event of late payment, reminders may be followed by legal action.
  • Any dispute must be made in writing within 5 days.

7. Down payments

Chris Medical Services reserves the right to require a deposit or full payment prior to the event. In the event of non-payment, the service may be cancelled without compensation.

8. Modified hours

  • Overtime will be billed at the hourly rate with no surcharge.
  • Hours not worked will be deducted from the invoice.
  • A minimum of 3 hours of service is charged.
  • Mission reports are in place.

9. Cancellation

  • In the event of cancellation by the customer, the deposit remains the property of the service provider.
  • In the event of cancellation by the service provider, the amounts paid will be reimbursed.
  • In the event of cancellation by the customer less than 48 hours before the event, 50% of the total amount will be charged.
  • In the event of cancellation less than 48 hours before the event, 100% of the amount is due.

10. Insurance

  • The service provider is covered by professional liability insurance.
  • The customer must have insurance covering his own activities and those of his employees.

11. Health and safety

  • The service provider applies current health and safety standards.
  • The customer guarantees access to a suitable place for pick-up, with water and toilet facilities.

12. Data protection

Customer data may be used for internal purposes or for anonymous promotional purposes. No transmission to third parties without consent, except in cases provided for by law. The customer may at any time request to no longer receive communications.

13. Limitation of liability

The provider’s liability is limited to proven direct damage. It excludes loss of business, delays, indirect losses, theft or loss of personal belongings. The service provider is bound by an obligation of means.

14. Privacy

The service provider and his staff are bound by medical confidentiality. The customer only receives an anonymized health report.

15. Applicable law and place of jurisdiction

Swiss law applies. The place of jurisdiction is Mont-sur-Lausanne, unless otherwise stipulated.
